GlowNiq provides AI-powered skin analysis services through mobile applications and web platforms. The Service uses artificial intelligence technology to analyze skin conditions and provide informational recommendations.

Key Features - AI-based skin condition analysis - Personalized skincare recommendations - Analysis history tracking - Credit-based usage system (Basic, Standard, Premium tiers) - Multi-language support (English, Turkish, Dutch)

Analysis Tiers

Basic Analysis (Free): - Standard AI model (Gemini 2.0 Flash) - Essential skin type detection - Basic concerns identification - General skincare routine recommendations - Limited analysis credits per month

Standard Analysis: - Advanced AI model (Gemini 2.0 Flash Thinking) - Detailed skin type analysis - Comprehensive concerns assessment - Personalized morning and evening routines - Category scores (hydration, texture, tone, etc.) - Unlimited standard analyses

Premium Analysis: - Multiple premium AI models (GPT-4o, Claude 3.5 Sonnet, Qwen 2.5 VL) - Most detailed and accurate analysis - Advanced visual assessment - Comprehensive personalized recommendations - Detailed progress tracking - Priority processing - Extended analysis history

3. Account Registration and Authentication

Account Creation - You must be at least 13 years old to create an account - You must provide accurate and complete information - You are responsible for maintaining account security - One account per person; no sharing of accounts

Authentication Methods We offer multiple secure authentication methods: - Email/Password: Traditional login with secure password - Google Sign-In: OAuth authentication via Google - Apple Sign In: OAuth authentication via Apple (iOS only) - Email OTP: One-time password sent to your email

Authentication Provider We currently use Logto as our authentication provider and may change providers from time to time to ensure: - Secure login and session management - Industry-standard security protocols - Protected access to your personal data

Session Management - You remain logged in until you explicitly log out - Authentication tokens are securely stored on your device - Sessions automatically expire after extended periods of inactivity - You can manage active sessions from your account settings

4. Credits and Purchases

Credit System - Analysis services require credits based on tier - Credits are purchased through: - Mobile: Apple App Store or Google Play Store (via RevenueCat) - Web: Stripe secure payment gateway - Credits are non-transferable and non-refundable - Unused credits remain valid as long as your account is active

Pricing - Credit packages and subscription plans are displayed in the app/website - Prices may vary by region and payment method - Promotional pricing is subject to terms and availability - All prices shown in your local currency

Refunds - Except as required by law, all purchases are final and non‑refundable. - EU/EEA consumers (web purchases via Stripe): You have a 14‑day right of withdrawal from the date of purchase if you have not started using the Service. If you ask us to start providing the Service immediately (e.g., by using credits during the cooling‑off period), you acknowledge that you lose the right of withdrawal for the portion of Services already provided. - Mobile purchases (Apple/Google): Refunds are handled by the respective app store according to their policies. Please submit refund requests directly through your store account. - Defective/failed delivery: If credits or subscriptions you purchased are not delivered or are defective, contact privacy@glowniq.be within 14 days; we will repair, replace, or refund as required by applicable consumer law.

5. Acceptable Use

Permitted Use - Personal, non-commercial skin analysis - Educational purposes - Following provided recommendations for informational purposes

Prohibited Use You may NOT: - Use the Service for medical diagnosis or treatment decisions - Share your account credentials with others - Attempt to reverse engineer or exploit the Service - Upload inappropriate, illegal, or offensive content - Use the Service for any automated or bulk analysis - Violate any applicable laws or regulations - Circumvent credit or payment systems - Interfere with other users' experience - Use automated tools to access the service - Upload photos of any person other than yourself without their explicit consent - Upload photos of minors (under 13)

IMPORTANT: GlowNiq is NOT a medical service and does not provide medical advice.

• GlowNiq does not diagnose, treat, or cure any medical conditions

• Emergency medical conditions require immediate medical attention
• We are not liable for decisions made based on AI analysis results

7. AI Analysis and Accuracy

Technology We use advanced AI models from reputable providers to deliver accurate skin analysis: - Basic: Gemini 2.0 Flash (Google) - Standard: Gemini 2.0 Flash Thinking (Google) - Premium: GPT-4o (OpenAI), Claude 3.5 Sonnet (Anthropic), Qwen 2.5 VL (Alibaba)

Accuracy Limitations - AI analysis is not perfect and may contain errors - Results depend on photo quality and lighting conditions - Analysis accuracy improves with model updates - We do not guarantee specific outcomes or accuracy levels - Different AI models may provide different insights

Model Selection - Basic tier uses free AI models - Standard tier uses advanced thinking models - Premium tier rotates between best available models - Model selection based on availability, quality, and task complexity

8. Intellectual Property

Our Rights All Service content, including but not limited to: - Software code and algorithms - User interface design - AI models and analysis methods - Branding and trademarks

Are owned by GlowNiq and protected by intellectual property laws.

Third‑party AI models and related technologies integrated into the Service are owned by their respective providers. Our rights apply to our proprietary software, prompts, and configurations.

Your Content - You retain ownership of the photos you upload. - You grant us a limited, non‑exclusive, revocable, worldwide license to host, process, and display your photos solely to provide the Service to you (for example, to perform AI analysis, display results, and deliver support). - We do not use your photos or analysis outputs to train third‑party AI models. We may use aggregated, de‑identified metrics (not photos or analysis outputs) to improve and develop the Service, as described in our Privacy Policy. - You can delete your content at any time in the app; deletion timelines are described in our Privacy Policy.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Effect of Termination - Access to the Service will be revoked - Unused credits will be forfeited - Your data will be deleted within 30 days unless retention is required by law - Purchase records retained for 7 years (legal compliance)

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: - Merchantability - Fitness for a particular purpose - Non-infringement - Accuracy of analysis results - Uninterrupted or error-free operation - Availability of specific AI models

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: - GlowNiq is not liable for any indirect, incidental, or consequential damages - Our total liability is limited to the amount you paid for the Service in the past 12 months - We are not responsible for decisions made based on AI analysis results - We are not liable for third-party service failures (app stores, payment processors, AI providers) - We are not responsible for loss of data or content - We are not liable for unauthorized access to your account

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or for death or personal injury caused by negligence, and your mandatory consumer rights.

13. Indemnification

You agree to indemnify and hold GlowNiq harmless from any claims, damages, or expenses arising from: - Your use of the Service - Your violation of these Terms - Your violation of any rights of others - Your uploaded content - Decisions made based on analysis results

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through: - In-app notifications - Email notifications - Website banner notices - Updated "Last Updated" date

Notice Period: 30 days for significant changes

Continued use after changes constitutes acceptance of modified Terms.

15. Governing Law

These Terms are governed by the laws of Belgium, without regard to conflict of law principles. If you are a consumer resident in the EEA, you also benefit from any mandatory protections provided by the law of your country of residence.

16. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be resolved through: 1. Good‑faith negotiation (first) 2. Mediation (if negotiation fails) 3. Courts of Antwerp, Belgium (or the courts of your country of residence where mandatory consumer law provides)

19. Platform-Specific Terms

App Store Terms (iOS) - These Terms are between you and GlowNiq, not Apple - Apple has no obligation to provide support for GlowNiq - Apple is not responsible for the App or content - You comply with all applicable third-party terms when using GlowNiq - Purchases through Apple are subject to Apple's terms - Apple and its subsidiaries are third‑party beneficiaries of these Terms and may enforce them

Google Play Terms (Android) - These Terms are between you and GlowNiq, not Google - Google has no obligation to provide support for GlowNiq - Google is not responsible for the App or content - Purchases through Google Play are subject to Google's terms

Web Platform Terms - Web access requires modern browser (Chrome, Safari, Firefox, Edge) - Payments processed securely through Stripe - Web-specific features may differ from mobile apps - Service availability may vary by region

20. Service Availability

We strive to provide reliable service, but: - Service may be temporarily unavailable for maintenance - We do not guarantee uninterrupted access - Analysis generation times may vary based on demand and AI model availability - We reserve the right to modify or discontinue features - AI model availability may change based on provider status

21. User Conduct and Safety

Age Requirements - Minimum age: 13 years old - Users 13-17 should have parental guidance - Age verification may be required

Content Guidelines - Upload only appropriate, legal photos - No offensive, violent, or illegal content - No photos of minors (under 13) - No impersonation or fraudulent uploads - Do not upload images of other individuals without their explicit, informed consent

Community Standards - Respectful interaction with support staff - No harassment or abusive behavior - No spam or promotional content - No attempts to exploit system vulnerabilities
